Consumer Terms of Service
1. Acceptance of these Terms
These Consumer Terms ("Terms") govern your access to and use of the HWA platform ("Service") as an attendant, parent, guardian, student, or other end user (collectively, "you"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to create an account. The Service may be used by minors only under the supervision and responsibility of an authorized adult.
3. The Service
HWA provides tools for educational centers to manage calendars, attendance, communications, and related activities. As a consumer user, you interact with the Service primarily through the educational center that invited you ("Operator").
4. Your Account
- You are responsible for keeping your credentials confidential.
- You must provide accurate and up-to-date information.
- You must notify us immediately of any unauthorized use of your account.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of applicable Colombian law, including Ley 1581 de 2012.
- Upload content that infringes intellectual property or privacy rights.
- Attempt to access data of other users without authorization.
- Interfere with the operation, security, or integrity of the Service.
6. Content You Submit
You retain ownership of content you submit. You grant HWA a limited, non-exclusive license to host, process, and display such content solely to operate the Service on behalf of the Operator.
7. Communications
By using the Service you consent to receive transactional notifications (account, attendance, calendar events) by email, push, or in-app message. Marketing communications, if any, require separate opt-in.
8. Third-Party Services
The Service may rely on third-party providers (including identity providers such as Auth0). Their terms and privacy notices apply to your use of those components.
9. Suspension and Termination
We may suspend or terminate your access if you breach these Terms, if required by the Operator, or if necessary to protect the Service or other users. You may delete your account at any time, subject to retention obligations described in the Privacy Policy.
10. Disclaimers
The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. HWA does not warrant uninterrupted or error-free operation.
11. Limitation of Liability
To the extent permitted by law, HWA's aggregate liability arising from these Terms shall not exceed amounts you paid to HWA in the twelve (12) months preceding the claim, or COP $100,000 if no amounts were paid.
12. Changes to the Terms
We may update these Terms. Material changes will be notified through the Service at least fifteen (15) days before they take effect. Continued use after the effective date constitutes acceptance.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Colombia. Any dispute shall be submitted to the competent courts of Bogotá D.C.
